While controversies exist regarding the scope of the law, there is no question that EMTALA applies to active labor, a key tenet of the statute and the only medical condition — labor — specifically included in the title of the law. In light of rising maternal mortality rates in the United States, further exploration into the state of emergency obstetrical OB care is warranted. OB-related cases were identified using keywords in settlement descriptions.

We described characteristics of settlements including the nature of the allegation and compared them with non-OB settlements. One in five settlements involved a pregnant minor, indicating that providers may benefit from education regarding obligations to evaluate and stabilize minors absent parental consent. Failure to arrange appropriate transfer was more common among OB settlements.

Findings suggesting need for providers to understand EMTALA-specific requirements for appropriate transfer and for EDs at hospitals without dedicated OB services to implement policies for evaluation of active labor and protocols for transfer when indicated.

Emergency Medical Treatment and Active Labor Act

The law's initial intent was to ensure patient access to emergency medical care and to prevent the practice of patient dumping, in which uninsured patients were transferred, solely for financial reasons, from private to public hospitals without consideration of their medical condition or stability for the transfer. Although only 4 pages in length and barely noticed at the time, EMTALA has created a storm of controversy over the ensuing 15 years, and it is now considered one of the most comprehensive laws guaranteeing nondiscriminatory access to emergency medical care and thus to the health care system. Even though its initial language covered the care of emergency medical conditions, through interpretations by the Health Care Financing Administration HCFA now known as the Centers for Medicare and Medicaid Services , the body that oversees EMTALA enforcement, as well as various court decisions, the statute now potentially applies to virtually all aspects of patient care in the hospital setting. Thus, all physicians on the hospital staff, not just emergency physicians, need to be familiar with its general requirements. This article summarizes the historical context of EMTALA and discusses the requirements of the statute both in the law's original language and in the subsequent interpretations by HCFA and the courts. It includes discussions of on-call physician responsibilities under the statute, penalties, and enforcement procedures.

The statute prohibits discrimination of emergency department ED patients for any reason. The objective of this study is to determine the scope, cost, frequency and most common allegations leading to monetary settlement against hospitals and physicians for patient dumping. There were 22 Hospitals failed to accept an appropriate transfer in 25 There were 13 6. In 12 6. Increasing instances of refusal of care to patients with emergency medical conditions EMC prompted Congress to pass this unfunded mandate that required hospitals to:.

Its original intent and goals are consistent with the mission of ACEP and the public trust held by emergency physicians. An emergency medical condition is defined as "a condition manifesting itself by acute symptoms of sufficient severity including severe pain such that the absence of immediate medical attention could reasonably be expected to result in placing the individual's health [or the health of an unborn child] in serious jeopardy, serious impairment to bodily functions, or serious dysfunction of bodily organs. Under the law, a patient is considered stable for transfer if the treating physician determines that no material deterioration will occur during the transfer between facilities. There is a 2-year statute of limitations for civil enforcement of any violation. Penalties may include:. An adverse patient outcome, an inadequate screening examination, or malpractice action do not necessarily indicate an EMTALA violation; however, a violation can be cited even without an adverse outcome.

EMTALA requires most hospitals to provide an examination and needed stabilizing treatment, without consideration of insurance coverage or ability to pay, when a patient presents to an emergency room for attention to an emergency medical condition. Statute and regulations - This section also includes the materials relating to the State Operating Manual and the Interpretive Guidelines used by CMS in doing hospital compliance surveys. Although originally brief by contemporary standards at a mere 4 pages, this law is now one of the most comprehensive and significant pieces of legislation preventing hospitals from denying patient access to emergency medical treatment on the basis of socioeconomic factors. Although the legislation has been enforced by the Centers for Medicare and Medicaid Services CMS , with numerous institutions being fined or investigated for violations, very little literature or precedent exists regarding the use of telemedicine for stabilization of patients presenting to the Emergency Department ED with regard to compliance with EMTALA.

It requires hospital Emergency Departments that accept payments from Medicare to provide an appropriate medical screening examination MSE to anyone seeking treatment for a medical condition , regardless of citizenship , legal status , or ability to pay. Participating hospitals may not transfer or discharge patients needing emergency treatment except with the informed consent or stabilization of the patient or when their condition requires transfer to a hospital better equipped to administer the treatment. The cost of emergency care required by EMTALA is not directly covered by the federal government , so it has been characterized as an unfunded mandate.

- Ein Ring!
